Terms of Service

The terms for using Pack AI Studio, including what the label, barcode and state rule tools do and do not do.

These terms are an agreement between you and PACK AI STUDIO ("we", "us") for your use of packaistudio.com and its tools (the "service"). By using the service you accept them. If you don't agree, please don't use it.

If a translation of these terms differs from this English version, the English version applies.

1. Who can use the service

You must be at least 13 years old. If you are under 18, you need the permission of a parent or guardian. If you use the service for a business, you accept these terms for that business.

2. The service

The packaging tools (dielines, box templates, nutrition labels, barcodes, labels and food labels) are free to use. We plan to add AI features, which will be paid; their prices and any extra terms will be shown before you buy. We may change, add or remove features, and we may stop offering part of the service.

3. Your account

You don't need an account to use the tools. If you create one, give accurate information, keep your password private, and tell us if you think someone else is using your account. You are responsible for what happens under your account. We may suspend or close accounts that break these terms.

4. Your designs and files

  • They are yours. You own the designs you make and the files you export, and you may use them commercially, including the box templates and label templates as starting points.
  • What you give us. When you save a design to your account, you allow us to store and process it only to provide the service to you.
  • What you put in. You are responsible for the text, logos and images you add, and for having the right to use them.

5. Acceptable use

Don't use the service to break the law or infringe anyone's rights; to make labels or packaging intended to mislead buyers or regulators; to upload malware or attack the site; or to overload, scrape or copy the service in bulk.

6. Labels, barcodes and regulatory information

The tools help you apply published rules. They are not legal, regulatory or professional advice, and they don't certify or approve anything.

  • Nutrition and food labels. The tools apply the FDA formats and rounding rules to the information you enter. FDA does not approve food labels before they are sold; you are responsible for the accuracy of your data and for your label's compliance.
  • Barcodes. The barcode tools draw symbols and check digits for the numbers you provide. For retail use, UPC and EAN numbers must come from GS1. Scan a printed proof before you print in volume.
  • Cottage food and other state rules. State statements and requirements are taken from each state's sources as of the date shown on the tool. Laws change; check with the agency that regulates your business.
  • Dielines and templates. Check dimensions with a printed proof and with your printer before a production run.

7. Our property

The site, its software, its design and the PACK AI STUDIO name and logo belong to us. These terms don't give you any right to them beyond using the service as intended.

8. Other services

The service links to and relies on third parties, such as sign-in providers, hosting and payment processors. Their terms and policies apply to your use of their services, and we are not responsible for them.

9. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the service will be uninterrupted or error-free, or that its output will meet any legal requirement that applies to you.

10. Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, products or print runs, arising from your use of the service. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50.

11. Indemnity

If your use of the service or your designs breaks these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim.

12. Ending

You can stop using the service at any time and ask us to delete your account. We may suspend or end your access if you break these terms. Sections 4, 6 and 9 to 13 continue after your access ends.

13. Law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Disputes will be heard in the state or federal courts located in Delaware, and you and we agree to their jurisdiction. If you are a consumer, this doesn't take away any protection the law of your own country or state gives you.

14. Changes to these terms

We may update these terms. We will change the date above, and if a change is significant we will tell you on the site or by email before it takes effect. If you keep using the service after that, the new terms apply.

15. General

These terms, with the privacy policy, are the whole agreement between you and us about the service. If a court finds part of them unenforceable, the rest stays in effect. If we don't enforce a term right away, we can still enforce it later. You may not transfer these terms without our consent; we may transfer them with the service.
